Aloha! Welcome to Fly Shuttle Tours! We are happy to serve you with our convenient and comfortable transportation services between Daniel K. Inouye International Airport (HNL) and hotel and resort properties on Oahu such as Marriott Bonvoy Resort Properties; Moana Surfrider, A Westin Resort & Spa, Waikiki Beach; Sheraton Waikiki; Sheraton Princess Kaiulani; and Royal Hawaiian Hotel. 


Terms of Service

Reservations
When you make a reservation on our system, it will provide you the best times for your pickup. If you don’t follow the system’s recommended pickup times and select a time that is not recommended by the system, you are doing so at your own risk. Please check your airline’s check-in procedures, so you can set aside enough time to be able to connect with your flight. Fly Shuttle Tours is not responsible for any missed airline flights.

Order Process
Upon placing an order with Fly Shuttle Tours, please review details before confirming it. Specifically, please be sure to check the payment method and details of the service and/or product. After you confirm your order, upon our acceptance of your order, we will send you a notice, therefore, binding the agreement on both parties for the contractual sale.

At times, we may require further information before accepting an order. Fly Shuttle Tours retains the right to refuse or cancel any order prior to delivery of the service or product. We will notify you if any part of your order is cancelled or if more information is required. If your order is cancelled after payment has been processed but prior to delivery of the service or product, we will refund your payment.

Changes in Reservations
For arrival reservations, they are only valid for the date specified. In regard to departure reservations, they are only valid for the date and time specified. Rates may change when you modify any part of your reservation including but not limited to date, time, location to be picked up or dropped off, amount of people to be transported, and special requests.

Errors by User
Fly Shuttle Tours will not be responsible for errors you make when making your reservation. You are responsible to make sure you provide accurate information at such time. When you receive a confirmation email with details of your reservation, please review your confirmation email that includes details of your reservation to make sure everything is correct. Please contact us as soon as possible if you need to make any changes.

Payments
To reserve your seat with Fly Shuttle Tours, a complete payment in U.S. dollars is due at reservation. Upon successful completion of your reservation, you will receive a confirmation code. Keep this code for reference when making changes to your reservation.

By your actions in executing a payment with us, you are giving us your representations and warranties that you are authorized to make the payment with the payment method used, that all payment information that you presented to us is correct, and that you will let us know when there are any changes in your payment information.

Fly Shuttle Tours does not accept cash payments for a majority of our services. We accept credit and/or debit cards. Only credit cards are accepted for orders made on our website. When we do accept cash payments, all sales transactions for reservations are final. We do not issue refunds for cash payments.

If you make an international charge or payment to Fly Shuttle Tours, it will be converted into U.S. Dollars when charged and be subjected to the exchange rates controlled by the policies of the entity that issued the card.

The security and confidentiality of your personal information and credit card information are important. to us. Thus, we have a security management system programmed to protect your personal information and credit card information to ensure it remains safe and private.

Delay or Missed Pickup
Fly Shuttle Tours receives your flight information from the time of your confirmation of your reservation. Please contact us as soon as you can when there are any changes, delays, or cancellations to your flight, so our staff can make adjustments to your reservation.

For departure pickups, please be at the pick-up location at least 5 minutes before your designated departure time. Please review your flight departure time to ensure you set aside enough time to connect with your flight. Fly Shuttle Tours is not responsible for missed flights.

Please keep in mind that Hawaii can get bad traffic during the morning and afternoon rush hours as well as from unexpected conditions such as but not limited to accidents, emergencies, and bad weather. Fly Shuttle Tours is not liable for delays due to these conditions. We reserve the right to cancel or modify scheduled pick-ups for such conditions mentioned above.

Time Limitation for Claim for Delay or Missed Pick-up. If you believe Fly Shuttle Tours was at fault for a delay or missed pick-up, please file a claim with us at info@flyshuttle.com within 24 hours of the service or forfeit the right to make a claim. If it is determined that Fly Shuttle Tours was at fault for the delay or missed pick-up, resolution may include a partial or complete refund, reservation credits for a future service, or other means.

Refund Process for Delay or Missed Pickup. Once refunds have been approved, please allow 10 to 12 working days to see it for processing.

Cancellations

For reservations made by credit or debit card, cancellations must be made at least 24 hours before the scheduled service (and no less than 24 hours), in order to receive a refund. There will be a 10% service fee charged to you for cancellations. Please allow 10 to 12 working days for refunds to be processed.

Please be aware that any cancellation made less than 24 hours prior to the scheduled service will result in a charge, thus, there will be no refund.

Provisions of Service

It is your responsibility to be aware of and abide by state and federal laws at all times. Fly Shuttle Tours assumes no liability for guests’ actions while on the transfers service. Please not that smoking is not allowed on any of our vehicles pursuant to Hawaii State Law HRS328J.

Americans with Disabilities Act (“ADA”)

At the time of your reservation, please mention any special arrangements you will need if you or a member of your party is disabled. Since we need to make preparations and have a limited amount of ADA vehicles, we require you to make an ADA reservation at least 48s hours prior to the scheduled service. We will do all we can to meet the needs of our disabled guests.

Pertaining to electric wheelchairs/scooters, the combined weight of the wheelchair/scooter and guest cannot go over 500 pounds. The space on our platform that lifts the wheelchair/scooter and guest is 48 inches by 30 inches. 50 pounds is the maximum weight that our drivers can carry into our vehicles.

Luggage and Personal Items
Please keep track of all of your valuables and important items. Keep them with you during transportation and at any drop-off and/or pick-up points to avoid losing them. Fly Shuttle Tours is not liable for the loss or theft of such property. Nevertheless, Fly Shuttle Tours will do what it can to assist you to reconnect with your lost item if it is found. Please contact info@flyshuttle.com as soon as possible. The owner will be responsible for paying any fees needed to return an item found.

Fly Shuttle Tours is not liable for normal wear and tear that normally occurs during transportation such as but not limited to broken baggage and broken goods that are fragile or not properly secured inside the luggage, unless the baggage is in transit, in which case the maximum liability for any single piece is $100.00 or the cost of repair or replacement, whichever is lower and the maximum liability for any single guest is $250.00 or the cost of repair or replacement, whichever is lower.

Time Limitation for Claims for Loss or Damaged Personal Property. Guests must report damage or loss of any personal items during the transportation service to info@flyshuttle.com within 24 hours or lose forfeit the right to make a claim. Fly Shuttle Tours holds the right to inspect the damaged item(s) and determine the type and amount of reimbursement, if any, based on the damages. If it is determined that Fly Shuttle Tours was at fault for the loss or damage of your personal property, resolution may include a partial or complete refund, reservation credits for a future service, or other means.

Refund Process for Loss or Damaged Personal Property. Once refunds have been approved, please allow 10 to 12 working days for processing.

We strongly encourage feedback on the service, both good and bad. Upon receipt of negative feedback, we will investigate and provide a resolution. If it is determined to be Fly Shuttle Tours ‘s fault, resolution typically includes compensation in partial or complete refund, reservation credits towards a future service, or other means.

Time Limit
No action shall be maintained for loss or damage to a passenger’s property or for delayed or missed pickup unless notice of the claim is presented to the carrier within twenty four (24) hours of the occurrence of the loss, delay, damage or injury and unless the claim is actually filed in writing within thirty (30) days of such occurrence. All other terms and conditions are based on our filing by Hawaii Public Utilities Commission and the Department of Transportation of the State of Hawaii.

By using our website and our services, you agree to be legally bound by the terms set forth here and included through reference. If you are using our website and our services on behalf of an entity, you must be authorized to accept these terms on their behalf and they must agree to indemnify you and Fly Shuttle Tours for any violations of the terms herein. You must agree to all terms to use our website and our services.

The terms apply to Fly Shuttle Tours, Fly Shuttle Tours, Inc. and/or its affiliates including but not limited to all of our tours, activities, products, facilities, transportation, services and websites. Additional terms and conditions may apply and in the event of a conflict, prevail over these terms.

Fly Shuttle Tours reserves the right to change or modify these terms of use or any other policies set forth in this website, at any time, and at its sole discretion. Fly Shuttle Tours , Fly Shuttle Tours, Inc., and its affiliates, directors, employees, shareholders, suppliers, officers, and agents shall not be held liable for any damages of any kind including but not limited to any type of loss, injury or damage arising out of or in connection with the Sites including content contributed by other companies. This includes without limitation any damages arising from reliance by a user on any information obtained from Fly Shuttle Tours or that result from mistakes, inaccuracies, omissions, interruptions, deletion of files or email, errors, defects, viruses, delays in operation or transmission or any failure of performance, circumstances beyond our control, communications failure, theft, destruction or unauthorized access to our records, programs or services. You agree not to hold liable Fly Shuttle Tours, from and against any claims, causes of action, demands, recoveries, losses, direct, indirect, punitive or consequential damages, fines, penalties or other costs or expenses of any kind or nature.

These disclaimers and limitations do not affect your rights as a consumer. They are not intended to disclaim liability that cannot be legally excluded under our country of governance.

Choice of Forum
You agree that any legal action relating to these terms or to Fly Shuttle Tours shall be filed only in the state or federal courts located in the State of Hawaii, United States of America and you consent and submit to the personal jurisdiction of such courts for the purposes of litigating such action. Any disputes or claim must be presented within 30 days of service unless a longer period is mandated by law.

Choice of Law
These terms are governed by and construed in accordance with the laws, rules and regulations of the United States, the State of Hawaii, the City & County of Honolulu, the County of Hawaii, the County of Kauai, and the County of Maui. This includes but is not limited to the Hawaii Public Utilities Commission and the Department of Transportation of the State of Hawaii.

Termination
Fly Shuttle Tours reserves the right, without notice and at its sole discretion to termination your license to use this site and block or prevent your future access to, and use of, the site.

Severability
If any provision of these terms is deemed void for any reason enforceable, that provision shall be severable from the rest of the terms and not affect the validity or enforceability of any remaining provisions.

Moreover, please obey Hawaii and the U.S. government’s regulations regarding COVID-19. Fly Shuttle Tours is not liable for any laws that you violate.

Applicable Law

Any legal action relating to these policies or to Fly Shuttle Tours shall be determined in accordance with the laws of the State of Hawaii. Any and all claims, controversies, or disputes in dispute arising from or relating to these policies, or the breach thereof, which remain unresolved after direct negotiation between the parties, shall first be submitted to confidential mediation in accordance with the Rules, Procedures, and Protocols for Mediation of Dispute Prevention & Resolution, Inc. then in effect. The parties agree that a good faith attempt to resolve all issues in mediation is a pre-condition to further adversarial proceedings of any kind. If any issues, claims or disputes remain unresolved after mediation concludes, the parties agree to submit any such issues to binding arbitration before one arbitrator in accordance with the Rules, Procedures, and Protocols for Arbitration of Dispute Prevention & Resolution, Inc. then in effect. The parties further agree that the award of the arbitrator is binding upon the parties and that judgment upon the award rendered may be entered in a court in the State of Hawaii.

Severability
In the event that any of the provisions of these policies are found for any reason to be invalid or unenforceable in any respect, the invalidity or unenforceability shall not affect any of the other provisions of these policies, and these policies shall be construed as if such invalid, illegal, or unenforceable provisions were not contained herein.
